Legal right to withdraw from the purchase Right of withdrawal If you are contracting as a consumer and user, you have the right to withdraw from this contract within a period of 20 calendar days without the need for justification.
To exercise the right of withdrawal, you must notify us at Pasión Morena by writing to us at the email requests@pasionmorena.com your decision to withdraw from the contract (return the item (s)) through an unequivocal declaration:
- The return transport costs to the collection address by Pasión Morena will not be included in the event that the collection is made by Pasión Morena, without any undue delay and, in any case, no later than 3 calendar days from the date on which we are informed of your decision to withdraw from this contract, such collection will be made.
- We will proceed to make said reimbursement via transfer to the account number indicated by you within a period of no more than 20 days from the receipt of the product and after checking its status. Notwithstanding the foregoing, we may withhold the refund until we have received the goods, or until you have submitted proof of their return, depending on which condition is met first.
You must return or deliver the products directly to us at the address of our central warehouses (Calle Fray Juan Cobo Nº1, 45700 Consuegra (Toledo) or request via email (orders@pasionmorena.com) or by telephone (925095330) the return through of a messenger / Courier sent by Pasión Morena, without any undue delay and, in any case, within a maximum period of 20 calendar days from the date on which you notify us of your decision to withdraw from the contract.
- In the event that the product is defective upon receipt of it, you must contact Pasión Morena in any of the aforementioned, telephone or email, sending an image of the product and its defect, without prior handling of any of its labels, so Pasión Morena can take care of the collection and delivery of the new one.
The deadline will be considered fulfilled if you return the goods before the deadline has expired. Through a courier / courier organized by us, you must bear the direct cost of returning the goods. You will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the goods, in this case the product will be valued.
Contractual right of withdrawal In addition to the right of withdrawal legally recognized to consumers and users and mentioned in the previous clause, we grant you a period of 20 days from the Shipping Confirmation to make returns of the products (except for those mentioned in the following clause, with respect to which the right of withdrawal is excluded).
In the event that you return the products within the contractual term of the right of withdrawal, but once the legal term has elapsed, only the price paid for such products will be reimbursed. You will be responsible for the direct costs of returning the product or through a courier / courier organized by us.
